Do you know one to share? I have at least two.
I live in California, the San Francisco Bay Area, it can't get any more liberal than this. I don't believe in anything extreme so when the extreme liberalism happens right in front of me, it's just irritating. In some cases, it happens to me.
California is all about protecting the underprivileged, the poor, the sick, the victim. Sounds just, right? I am all for it but my problem is that the laws misidentify who the real victims are.
I am telling you one I have to deal with right now.
As some of you ladies know, I am renovating a house. We got this house in 9/2020, interviewed 8 contractors and selected this one to work with. The project started in November last year, it is now almost a year later and it is not done. The promised completion date was 16 weeks. They blamed it on the death of the main structural engineer, the fall out with the architect, the numerous permits that the city requires etc... We finally have them fired everyone, we brought in our own engineer, our own architect, I personally contacted the city which turned out to be extremely helpful, they never took more than 24-48 hours to move my request once the documents were uploaded by the engineer. But the delay got worse, and we found out that the firm we hired is not paying the subcontractors so they don't show up for work as frequent as they should.
The terrible thing is, the subs can sue us if they don't get paid by the firm, they can request to put a lien on our property until they are paid so we are responsible to make the firm pay them. This is due to a law called Mechanic Lien. In a way, our house might not get done, we pay the firm for every milestone, but if they don't pay their subs, we will be liable as well. Aren't we the victims too? Why are we being penalized?
WTF? I am so mad right now. I feel like I am in a catch 22 situation. Pay the firm so things can get done but they don't pay their subs, I might end up paying the subs, take the firm to court, pay the legal fee, entangle in a legal mess or do not pay, stop everything, get into arbitration...
The subs told me yesterday they have not been paid. I asked them why they are still working, they said because they might get paid. It's unacceptable, we will be calling the firm. We will be calling the lawyer very soon.
